Mohd Faruq, also known as Raju, was allowed to leave jail temporarily by the Delhi High Court on February 13, 2026. He was accused of being involved in the murder of truck driver Bindeswari Mishra. The decision was made by Judge Girish Kathpalia.

The Case Background

The case started on February 20, 2016, when Pankaj Mishra, the first person to report the incident, said that his cousin, Bindeswari Mishra, a truck driver, was missing. Bindeswari was last seen at Maan Dharamkanta, Libaspur, with two people, including Mohd Faruq. The next day, the truck was reportedly seen heading towards Etah, but Bindeswari could not be contacted.

The Arrest and Accusations

Mohd Faruq and another person, Lalman, were caught when they tried to run away. They supposedly admitted to selling the truck and told the police where to find Bindeswari's dead body. The lawyers against Faruq used indirect evidence, like the last time Bindeswari was seen and the finding of the truck, to argue their case.

Defense's Argument

Mohd Faruq's lawyer argued that he had been in jail since February 22, 2016, without solid proof against him. The defense questioned how trustworthy the indirect evidence was and pointed out that there was no direct connection to the crime.

Prosecution's Stand

The lawyers against Faruq did not want him to be released, highlighting the importance of a witness named Pramod, who saw a heavyset person driving the truck. They argued that the evidence of the last time Bindeswari was seen and the finding of the truck showed Mohd Faruq's involvement.

"The series of events does not clearly prove involvement," argued Mohd Faruq's lawyer.

Court's Decision

Judge Girish Kathpalia noted that the upcoming statement from Pramod would not change the case much. The court found no reason to keep Mohd Faruq in jail without stronger evidence and allowed him to leave jail temporarily by paying Rs.10,000.

Verdict Summary

The court decided to release Mohd Faruq from jail for now because there wasn't enough strong evidence to keep him locked up. The trial will continue separately to reach a final decision.
