Summary: The Delhi High Court has sent a case back to the National Consumer Disputes Redressal Commission (NCDRC) for another look. The case is between Ansal Housing Limited and Vikas Jain. The court found that the NCDRC's previous decision wasn't explained well and wasn't fair.
This back-and-forth started on January 7, 2025, when the NCDRC changed an earlier decision from July 5, 2024. Vikas Jain and others weren't happy with this change, so they asked for another change on February 10, 2025. The NCDRC agreed and made changes on February 25, 2025.
Ansal Housing wasn't happy with the February decision. They said the NCDRC made changes without listening to them. They took the issue to the Delhi High Court, which asked the NCDRC to look at the case again on July 31, 2025.
When the NCDRC reviewed the case again, they didn't address Ansal Housing's concerns. Justice Girish Kathpalia noted that the NCDRC's order didn't explain why they ignored Ansal Housing's points. He emphasized the importance of a fair hearing, saying:
"Right to effective and fair hearing has been bruised in the impugned order."
Because of these issues, the Delhi High Court canceled the NCDRC's decision on December 12, 2025, and asked for another review. Both parties are scheduled to meet with the NCDRC on December 18, 2025, at 10:30 AM.
The NCDRC has four weeks to come up with a decision that is clear and makes sense. The Delhi High Court wants to make sure that both sides are listened to and that the final decision is fair and justified.
