Summary: A court case in Mumbai involves Ashok and Asha Pipraiya challenging an eviction order from Ashok's mother, Lilabai, who says they mistreated her and wants her home back.

The Family Feud Begins

In 2025, Ashok Narayan Pipraiya and his wife, Asha, were living in a flat in Mulund, Mumbai. This apartment became the focus of a court fight when Ashok's mother, Lilabai, accused them of mistreatment and wanted them to leave.

Lilabai's Claims

Lilabai, a 71-year-old widow, said that her son and daughter-in-law were abusive and had kicked her out of her own home. She said they pressured her into giving the property to Ashok and then forced her to leave.

"They physically hurt me," Lilabai said in her complaint.

Ashok and Asha's Defense

Ashok and Asha denied these accusations, saying that Ashok had helped pay for the flat, even though it was in Lilabai's name. They claimed Lilabai left on her own to live with another son, Kishor, and that she was tricked into filing the complaint.

Legal Proceedings

The Maintenance Tribunal agreed with Lilabai on August 26, 2025, ordering Ashok and Asha to leave the flat. The Appellate Tribunal also supported this decision on October 29, 2025. Ashok and Asha then appealed to the Bombay High Court.

Court's Decision

Judge N.J. Jamadar handled the case, which was decided on March 5, 2026. The court rejected Ashok and Asha's appeal, stressing that Lilabai had the right to live peacefully in her home.

"Lilabai has the right to live a calm and normal life in her own house," the court said.

Key Legal Arguments

  • Ashok's Argument: The eviction order was not valid without a claim for financial support. They also argued that Lilabai didn't need money from them because she had other income.

  • Lilabai's Stand: She needed protection and the right to live in her own home without being bothered.

Final Outcome

The court rejected Ashok and Asha's appeal, allowing Lilabai to move back into her home. However, they were given three weeks to leave, as long as they didn't involve any third parties.
