
In a recent decision, the court canceled the charges against two people, Ravi Kumar and Anil Reddy, in a case involving breaking food safety rules. This decision was made by Judge Juvvadi Sridevi after a request was made under the Bharatiya Nagarik Suraksha Sanhita, 2023.
The case involved Ravi Kumar and Anil Reddy, who wanted to cancel the charges in F.I.R. No. 264 of 2025. The police report was filed at P.S. Raghnathapalli, Warangal District, for crimes under Sections 272 and 275 of the Bharatiya Nyaya Sanhitha, 2023. These sections are about crimes involving tampering with food.
The lawyers for the accused, led by Sri Y. Bala Murali, argued that the police were not allowed to investigate these crimes. He referred to a previous case, Chidurala Shyamsunder v. State of Telangana, which said that only a Food Officer can investigate and press charges under the Food Safety and Standards (FSS) Act, 2006.
"The Police are not allowed to handle cases under Sections 54 and 59(1) of the Food Safety and Standards (FSS) Act, 2006," argued the accused's lawyer.
Judge Juvvadi Sridevi agreed with the accused, referring to the earlier case of Chidurala Shyamsunder. The court found that the police went beyond their powers by filing the case under the mentioned sections of the Bharatiya Nyaya Sanhitha.
The court accepted the request to cancel the charges against Ravi Kumar and Anil Reddy. The accused can now ask for their seized property back. The trial court has been told to return the property once everything is properly noted.
"Ravi Kumar and Anil Reddy can ask the trial Court to give back their seized property," stated the order.
The court decided that the police were not the right authority to handle this case and canceled the charges against Ravi Kumar and Anil Reddy. The court directed that any property taken from them should be returned.
