The Delhi High Court has decided that Surendra Kumar Chaturvedi and another person should get their money back for apartments they were promised but didn't receive under a housing plan. The court found that the initial cancellation didn't say they lied, so they should get their money back, with interest.

The Background: Getting and Losing the Flats

Back in January 2006, Surendra Kumar Chaturvedi and Mrs. Manu Chaturvedi applied for apartments under a plan by the Delhi State Industrial Infrastructure Development Corporation Limited. They were given the apartments, but in September 2007, they got a notice asking them to explain. It said the apartments were meant for factory workers, and the Chaturvedis didn't qualify.

The Cancellation Order

Even though they replied to the notice, their apartment offer was canceled on February 14, 2012. The order said the offer went against the plan's purpose but didn't say they lied. They were told to return original papers to get their money back, but they waited until November 2020.

"The allotment secured by the appellants was contrary to the spirit of the Scheme."

The Fight for a Refund

They asked for their money back in September 2020, but the corporation said no, using rules about lying. However, this wasn't mentioned in the original cancellation order. The High Court, with Judges Devendra Kumar Upadhyaya and Tushar Rao Gedela in charge, found this reason to be wrong.

Court's Decision: Refund with Interest

The court decided on December 2, 2025, that they should get their money back, plus 6% interest from September 8, 2020. The corporation must check the amount and give them the payment.

"The respondent is directed to refund the cost deposited by the appellants... along with interest at the rate of 6% per annum."
