
In a recent case, the Telangana High Court addressed concerns about how the Special Tribunal makes decisions. Petitioners Smt. M Laxmi and Smt. K Shirisha argued they weren't given a chance to speak. Justice P. Naveen Rao has now provided a new way for these petitioners to make sure their voices are heard.
Smt. M Laxmi and Smt. K Shirisha challenged the Special Tribunal's decision. They claimed they didn't get a notice or a chance to present their side. This goes against the idea of a fair hearing.
"Before making decisions, notice was not given and a chance to speak was not provided."
The Division Bench had already looked into similar issues in another case. They directed that all cases should be revisited, and affected parties should be informed and given a chance to speak.
"Respondents shall issue public notices calling upon parties to appear before the Special Tribunals... to enable them to make their submissions."
Justice P. Naveen Rao has allowed Smt. M Laxmi and Smt. K Shirisha to appear before the Special Tribunal within ten days. They can ask for a personal hearing and must provide their contact details for communication.
"Petitioners are granted the freedom to appear before the Special Tribunal within ten days... and submit a request for a personal hearing."
The court hopes that the Tahsildar will not take any steps based on the previous decisions until new decisions are made by the Special Tribunal.
"It is hoped and expected that no steps be taken by the Tahsildar based on the orders of the Special Tribunal... till fresh orders are passed."
The court has ordered that Smt. M Laxmi and Smt. K Shirisha must be given a fair chance to present their case. The decision on the actual issue has not been made yet, ensuring that everyone's rights are protected.
