In a recent decision, the Delhi High Court allowed Rohit to be released from jail on bail. Rohit was accused of being involved in a dowry death case. The court looked at different factors before making this decision.
Rohit married Shivani on December 8, 2022. Sadly, on June 3, 2023, Shivani was found dead, and it was said she died by hanging. This sad event happened in Delhi and led to serious legal actions.
Shivani’s father accused Rohit and his family of being cruel because of dowry demands, claiming this pushed Shivani to take her own life. A police complaint was filed, and Rohit was arrested on June 6, 2023. Meanwhile, his family members were allowed to avoid arrest by getting a special court order.
"The person who complained gave some photos and an audio clip that were supposedly sent by Shivani, in which she talked about being mistreated and beaten by Rohit."
Rohit's lawyer, Mr. Manoj Kumar Duggal, argued that the evidence did not specifically show demands for dowry. He noted that Rohit had been in jail for over two years, and the investigation was finished.
On the other hand, Mr. Yudhvir Singh Chauhan, representing the state, argued that the case involved a young woman's unnatural death within seven years of marriage, which usually leads to serious charges under certain sections of the Indian Penal Code.
Justice Sanjeev Narula noted that the evidence, including an audio clip, did not clearly show demands for dowry. The court emphasized that bail is not meant to be a punishment before the trial.
"The main issue, even at this early stage, is whether there is evidence to suggest that Shivani was treated badly or harassed ‘soon before her death’ because of any dowry demand."
Rohit was allowed to be released on bail on November 24, 2025, under several conditions:
The court decided to grant bail to Rohit, considering both the seriousness of the accusations and his rights. The trial will continue, and the final decision will depend on the evidence presented.
