Quick Summary: On January 21, 2026, the Delhi High Court refused to let Mariyam @ Salma go free on bail in a drug-related case. Justice Girish Kathpalia made this decision, saying there were no new reasons to change the previous decision.

The Bail Application

Mariyam @ Salma, through her lawyers Mr. Arun Sharma and Mr. Sandeep Tyagi, asked to be released on bail. The case is connected to a police report filed at Hazrat Nizamuddin Police Station, involving drug-related crimes.

Previous Bail Rejection

Earlier, on December 2, 2025, another group of judges had turned down Mariyam's request for bail. The court had said there needed to be a change in the situation for a new request to be considered.

"The earlier bail application of Mariyam was dismissed by the co-ordinate bench by way of elaborate order dated 02.12.2025."

Co-Accused Sabir Ali's Bail

Another person involved, Sabir Ali, was allowed to go free on January 9, 2026. The court found no solid proof against him. His arrest was based on statements from Mariyam and another person involved, Akash. Nothing illegal was found on Sabir Ali.

The Evidence Against Mariyam

Mariyam was caught with her husband Akash, carrying about 12kg of marijuana on a scooter. After they were questioned, 71.27kg of marijuana was found in their house.

"Mariyam was apprehended and arrested on the spot... transporting approximately 12kg ganja."

Conscious Possession Argument

Mariyam's defense said she wasn't aware of having the drugs. However, the court found this argument weak against the tough rules of the drug law.

Final Decision

Justice Girish Kathpalia refused the bail request, stating that the conditions for a second bail request were not met.

"Therefore, the bail application is dismissed."

The verdict emphasizes how tough drug-related laws are and how difficult it is to get bail without major changes in the situation.
