Saurabh's Arrest and Defense

Saurabh was arrested on December 13, 2023. His lawyers argued that he was innocent and wrongly accused. They claimed there was no clear evidence against him, especially since the CCTV footage was blurry.

"The CCTV footage shows only one boy with a stick, not multiple attackers."

Evidence and Testimonies

The prosecution claimed that Saurabh's clothes had blood stains matching the victim's, and a stick was found. However, the stick had no blood stains. Two witnesses changed their stories, making the prosecution's case weaker.

"No lineup was arranged for identification, and the CCTV footage was unreliable for identifying anyone."

The Court's Decision

Judge Girish Kathpalia noted the inconsistencies in the evidence. He found the CCTV footage insufficient for reliable identification and questioned the lack of blood on the stick.

"I do not find the identification through CCTV in the present case, a reliable factor."

Bail Granted

Considering the circumstances, the court granted Saurabh bail with a personal bond of Rs.10,000. This decision was made to ensure freedom while awaiting trial.

"The bail application is allowed, and the accused is to be released on bail."

Saurabh was granted bail because there wasn't enough clear evidence against him.
