Summary: A court case in Coimbatore involves a temple land dispute. The request to drop the case was turned down, and the lawsuit will continue.
This legal battle is about a piece of land in Coimbatore where a temple is located. The main people involved are J. Gopalakrishnan and six others as the ones bringing the case, and P. Navaneethakrishna Raj along with others as the ones defending against it. The case is being heard in the Madras High Court by Judge R. Sakthivel.
The story goes back to 2014 when the Sree Shirdi Saibaba Matheswaran Trust filed a lawsuit claiming they should be in charge of the temple. They won at first, but the decision was changed in an appeal. The Trust tried again with another appeal in 2022, but it was rejected on August 4, 2022.
"The present lawsuit in O.S. No.394 of 2022 is a misuse of the legal system," argued J. Gopalakrishnan.
Despite the setbacks, the Trust, along with six other people bringing the case, filed a new lawsuit in April 2022. They are asking for a court order to stop interference with the temple land, which they claim is public land, or "poromboke."
Judge R. Sakthivel noted that the lawsuit might be an attempt to bother J. Gopalakrishnan and the other people bringing the case, but he decided not to dismiss it right away. He emphasized that the issues need to be looked at in court.
"Whether the temple is situated on public land... all these questions are to be decided in this case," stated Judge Sakthivel.
J. Gopalakrishnan and the others wanted the case dismissed before it even started, but the court said no. Now, the case will proceed in the lower court, where all the questions about the land and the temple's management will be addressed.
This ongoing saga highlights the complicated nature of disputes over land and religious sites. As the case continues, the courts will have to sort out the different claims to reach a fair decision.
