Here's a breakdown of the recent court decision where Mrs. Minal Desai's appeal was dismissed, confirming she owes Rs. 6,00,000 to Mr. Kawaljeet Singh for unpaid rent.
Back in June 2017, Mr. Kawaljeet Singh, who runs a movers and packers business in Delhi, agreed to store Mrs. Desai's office items. The deal was simple: Mrs. Desai would pay Rs. 25,000 monthly until she retrieved her items. However, she stopped paying rent from October 2019, leading to a legal battle.
"An agreement was made... under which Mrs. Desai had to pay monthly rent of Rs. 25,000."
Mrs. Desai had a history of not paying rent. In 2018, she settled an earlier dispute by paying Rs. 2,25,000 after failing to pay rent between December 2017 and August 2018. But the cycle repeated, and another case was filed for unpaid rent from October 2019 to January 2021.
"Mr. Singh filed a case to get back Rs. 4,00,000... this case was decided in his favor by the lower court."
In the latest case, Mrs. Desai argued that there was no valid written contract and claimed the case should not be treated as a business dispute. However, the court disagreed, saying that the transaction was indeed a business matter.
"The transaction is, therefore, business-related... the case has been rightly considered as a Business Case."
The court found that Mrs. Desai failed to provide evidence to support her claims. She didn't show up for inspections or provide any documents to counter the claims. The court maintained that the rent agreement was valid and enforceable.
"Mrs. Desai has not provided any evidence... the evidence from Mr. Singh remains unchallenged."
Ultimately, the court ruled against Mrs. Desai, upholding the lower court's decision. She now has to pay Rs. 6,00,000 plus interest to Mr. Singh.
