Here's an interesting story from the Madras High Court about a property dispute, a defendant who has passed away, and a mix-up with family members. Let’s break it down.

The Case Background

On March 16, 2020, P. S. Narasimhan filed a lawsuit in Tiruttani against Vijayalakshmi, seeking ownership of a piece of land. He claimed that someone had taken over his land and blocked access. The issue? Vijayalakshmi had passed away on February 23, 2016!

The Property Dispute

P. S. Narasimhan wanted the court to officially recognize him as the owner, order the removal of the building, and prevent any more building on the land. The property is part of a larger estate originally owned by Narasimhan’s mother, Kamalammal.

"The Plaintiff filed a complaint with the Deputy Superintendent of Police, Tiruttani, on March 15, 2020."

The Mix-Up

Dr. G. Rajendra Prasad, Vijayalakshmi's brother, argued that the lawsuit was invalid since it was against someone who had died. He wanted the court to throw out the case. However, he didn't provide the necessary documents to show he had the right to speak for Vijayalakshmi's son, K. Sathish Premnath, who lives in the USA.

Court's Decision

Justice R. Sakthivel decided that since no final decision had been made, the lawsuit wasn’t canceled just because it was against someone who had died. The court dismissed both requests:

  • C.R.P. No.2470 of 2023: Dr. G. Rajendra Prasad's request to dismiss the lawsuit was denied because he didn't submit the correct documents.
  • C.R.P. No.2472 of 2023: The court allowed P. S. Narasimhan to file a new request with accurate details about the family members.

"The Trial Court correctly made the decision, and this Court sees no reason to change it."

What’s Next?

P. S. Narasimhan can file a new request to include Vijayalakshmi’s family members in the case. The court has given him three weeks to do so.
