Background of the Case

Mohan Gangaram Narang, an 82-year-old resident, found himself in a legal fight when he discovered that his property was illegally transferred. The property is located in Turbhe, Navi Mumbai. Mohan claimed that his property was sold without his permission by people pretending to be him using fake documents.

The Alleged Fraud

According to Mohan, the fraudsters, named Suresh Patel and Ramesh Desai, made fake documents to transfer the property. They even managed to register a fake Apartment Deed on October 10, 2016, and a Transfer Deed on November 30, 2016. CIDCO, the City and Industrial Development Corporation, first gave a No Objection Certificate (NOC) but took it back on February 14, 2017, after realizing the fraud.

"CIDCO noted that someone pretending to be Mohan forged all the ID proof documents and tricked all the Authorities."

Court Proceedings

Mohan filed a case asking the court to cancel these fake documents. He also wanted to stop any further fake actions. Suresh Patel, who said he bought the property without knowing about the fraud, argued against the case. However, he admitted in his written statement that he was tricked by someone pretending to be the owner.

Judge's Decision

Judge N. J. Jamadar looked at the case and noted what Suresh Patel admitted. The judge said the admissions were clear, leading to a decision without needing a full trial.

"The admissions in the Written Statement are considered, then it becomes explicitly clear that the trial of the suit to the extent of cancellation of the documents in question is not needed."

Outcome

The court ordered the cancellation of the fake documents, declaring them invalid. It was also noted that this judgment does not affect any criminal cases that might come from the fraud.
