Summary: A request to stop criminal proceedings in Nalgonda, Telangana, was filed by Arpula Yadaiah and Arpula Vamshi. They claim that the charges are unfounded and are meant to trouble them because of ongoing disagreements over property or money. Justice Tirumala Devi Eada decided that the investigation should continue.
Arpula Yadaiah and his son, Arpula Vamshi, are from Chandur Town, Nalgonda District. They filed a request to stop the criminal case against them in FIR No.104 of 2024. The case involves accusations under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023.
The petitioners' lawyer, Sri E. Sreenivas Rao, argued that the accusations don't match the crime described in Section 318(4). He claimed the complaint is a way to change a civil disagreement into a criminal case, just to annoy the petitioners. He pointed out that Vamshi had already filed a civil case against the person who complained, and this criminal case was a payback move.
"The complaint is filed to change the nature of civil proceedings to that of criminal cases just to bother the petitioners."
The Additional Public Prosecutor, Sri Jithender Rao Veeramalla, insisted that even if there's a civil case, the person who complained can still pursue criminal charges. He emphasized that the investigation is ongoing and the petitioners should work with the police.
Justice Tirumala Devi Eada reviewed past cases and highlighted that civil cases don't stop criminal investigations if there's a basic case. The court noted that the investigation is just starting and didn't want to interfere at this early stage.
"The existence of civil proceedings on the same subject... is no reason to stop the criminal proceedings if there's a basic case."
The court decided not to stop the proceedings. Instead, it directed the police to finish the investigation quickly and urged the petitioners to work with them.
"The concerned police are to finish the investigation as soon as possible, strictly according to the law."
Justice Tirumala Devi Eada's decision ensures that the investigation will continue while respecting the legal steps involved in both civil and criminal cases.
