Summary: The court has temporarily stopped the tearing down of a building in Kukatpally, Hyderabad, after the owner, Mr. Rajesh Kumar, argued that the right steps weren't followed. The building had more floors than allowed, and now Mr. Kumar has a chance to explain.
In Kukatpally, Hyderabad, Mr. Rajesh Kumar faced a big problem. The Greater Hyderabad Municipal Corporation (GHMC) wanted to tear down his building. Why? Because the building had more floors than what was allowed. Mr. Kumar was supposed to build only three floors but ended up with six!
The GHMC sent a notice on October 18, 2025, saying they would tear down the extra floors. They had already warned Mr. Kumar in May and June of 2025, but nothing changed. The notice was based on Section 461-A of the GHMC Act.
"Mr. Rajesh Kumar was issued a warning... telling him to remove the extra floors."
Mr. Kumar's lawyer, Mr. M. Janardhan Rao, argued that the GHMC didn't follow the rules. They said the GHMC should have given another warning before taking action. Mr. Kumar felt this was unfair and against the rules.
Justice B. Vijaysen Reddy listened to both sides and made a decision. The judge didn't decide who was right or wrong. Instead, he said Mr. Kumar should have a chance to explain. Mr. Kumar now has three days to send his objections to the GHMC.
"The case is resolved with instructions for Mr. Rajesh Kumar to submit his objections/explanation... within three (3) days."
The GHMC must listen to Mr. Kumar's side and make a fair decision. Until then, the building stays as it is. This means no tearing down for now. The court wants to make sure everyone follows the rules correctly.
