The crash happened near Ghodbandar Gaon on the Mumbai-Ahmednagar Highway. Neil was seriously injured and, despite treatment, passed away on January 6, 2020.

The Legal Battle Begins

After Neil's death, his mother, Rajashri Pramanik Sable, asked the Motor Accident Claims Tribunal (MACT) in Mumbai for money to cover medical expenses and the loss of her son. The tribunal decided she should get ₹35,92,000 with 7.5% interest from the date she asked for it.

Reliance's Appeal: Challenging the Payout

Reliance General Insurance, represented by Ms. Kalpana Trivedi, disagreed with the decision on December 2, 2025. They said the amount was too high and that Neil's estimated income was wrongly calculated at ₹8,000 per month without proof. They also suggested that Neil and his father might not have followed traffic rules.

Defense Stands Firm

Rajashri's lawyer, Mr. Bharat Gadhavi, supported the tribunal's decision, saying it was fair and based on evidence. He argued that the accident was the truck driver's fault because it was a rear-end collision. The defense also showed medical bills and other papers to justify the compensation amount.

Court's Decision: Upholding the Compensation

Judge Aarti Sathe looked over the case and agreed with the tribunal's decision. She noted that the insurance policy was active at the time of the accident and that Reliance didn't prove that Neil's father was careless. The judge also referred to past court decisions to support the compensation for the loss of a child.

The court dismissed Reliance's appeal, allowing Rajashri to withdraw the compensation amount. The insurance company was given three weeks to pay if they hadn't already deposited the funds.
