The requests to be released on bail were first brought up on April 8, 2025, and September 17, 2025. However, these were postponed multiple times before being discussed by Judge Girish Kathpalia on February 12, 2026.

Arguments for Bail

Dipak's lawyer argued that the case was made up and pointed out delays in sending samples to the lab for testing. There was also a claim that the reasons for their arrest weren't clearly explained.

"The accused/applicant was illegally picked by the Special Staff and thereafter booked in the present case."

The state's lawyer explained that the delays happened because of necessary procedures and that the arrest was done properly. A similar case in the Supreme Court, State of Karnataka vs. Sri Darshan, was mentioned to argue that just because there were delays, it doesn't mean they should be let out on bail unless it can be shown that the delays caused unfairness.

Judge Kathpalia found no good reason to let them out on bail, citing the seriousness of the crime and the lack of proof that the accused didn't know why they were arrested.

"There are reasonable grounds for believing that the accused/applicants are not guilty of the offences charged with."
