Boini Kanakaraju appealed the decision, represented by Sri P. Sri Harinath, arguing that the tribunal ignored future medical costs and only partially covered his medical bills. He also asked for compensation for pain and suffering.
The car's owner, Jambula Venkat, didn't challenge the claims, while the insurance company, United India Insurance, argued that Venkat didn't have a valid driving license and questioned their responsibility.
Justice Tirumala Devi Eada reviewed the case. Evidence showed Boini Kanakaraju suffered three fractures, confirmed by Dr. I.S. Surendra, an Orthopedic Surgeon. Despite receiving free treatment under the Employee Health Scheme, additional medical expenses were incurred.
"Boini Kanakaraju was treated under the Employee Health Scheme, which is cashless."
The court increased the compensation to ₹1,31,246, recognizing additional medical expenses and the pain suffered. The insurance company was ordered to pay the increased amount with 7.5% interest, minus any delays.
"The enhanced amount of compensation shall carry interest @ 7.5% per year."
The court decided to raise the compensation amount to account for extra medical costs and the pain Boini Kanakaraju went through, ensuring a more fair outcome for the injured teacher.
