Quick Summary: Chesam Yasin's attempt to smuggle gold gets him into serious trouble as the Delhi High Court supports the fines imposed by customs.

The Seizure Incident

On July 19, 2022, Chesam Yasin arrived in Delhi from Imphal with a hidden stash. Customs officers found him carrying gold in paste form—three capsules weighing 1070.6 grams. After refining, the gold weighed 887 grams and was valued at Rs. 38,83,747.

Legal Proceedings Begin

The case started with Chesam Yasin filing a request on November 26, 2025, to challenge the holding of his gold. This was heard by Judges Prathiba M. Singh and Renu Bhatnagar.

Court Orders and Penalties

During a hearing on July 7, 2025, the court ordered a notice to be sent to Chesam Yasin explaining why action should not be taken against him. By November 24, 2025, the customs department submitted a statement, including an official decision dated October 24, 2024. The decision stated:

  • Complete Confiscation: The gold was taken away based on several parts of the Customs Act, 1962.
  • Penalties: A fine of Rs. 5,00,000 was imposed on Chesam Yasin and another Rs. 5,00,000 on the owner, Mr. Shakir, for the gold that was seized.

"I impose a penalty of Rs. 5,00,000/- under Section 112(a), 112(b) and Section 114AA of the Customs Act, 1962 on Mr. Chesam Yasin..."

Final Judgement

Even though fines were imposed, Chesam Yasin didn't have a copy of the official decision at first. The court allowed him to challenge the decision within two months. The case was closed, with all pending requests resolved.

Verdict Summary

The court confirmed the penalties and confiscation of the gold, allowing Chesam Yasin the opportunity to appeal the decision within a specified time frame.
