Telangana High Court: Investigation Continues Against Petitioners With Guidelines

No Objection from the Prosecutor

The Additional Public Prosecutor, Mr. Jithender Rao Veeramalla, did not object to the request for police directions. This meant Rajesh Kumar and Sunita Verma would need to cooperate with the investigation.

Court's Decision

Judge Eada found that the allegations did not constitute a crime under Section 316(5) of the Bharatiya Nyaya Sanhita. Since the other alleged crimes could result in less than seven years in jail, the court decided not to stop the legal actions. Instead, Rajesh Kumar and Sunita Verma were told to meet with the Investigating Officer.

"The accused must meet with the Investigating Officer on or before 04.11.2025," stated Judge Eada.

Investigation Guidelines

The court emphasized that the investigation should follow the rules in Section 35(3) of the BNSS and follow the Supreme Court guidelines from the case Arnesh Kumar v. State of Bihar. Rajesh Kumar and Sunita Verma must fully cooperate by providing necessary information and documents.

Conclusion of the Petition

With these points, the criminal petition was closed, and any other pending requests were also closed.
