The Motor Accident Claims Tribunal in Mettur initially awarded Rs. 35,20,000 to the family on July 8, 2022. Royal Sundaram Alliance Insurance Co. Ltd. challenged this decision, arguing that Senthil Kumar was responsible for the accident due to improper parking.
"The deceased was solely responsible for the accident for having parked the truck in the middle of the road," claimed Royal Sundaram Alliance Insurance Co. Ltd.
The case was heard by Justices R. Suresh Kumar and Dr. A.D. Maria Clete. The court examined evidence, including bank statements and testimonies, and decided to increase the compensation.
The total compensation reached Rs. 4,541,000.
The court dismissed Royal Sundaram Alliance Insurance Co. Ltd.'s appeal and partially allowed the counter-argument by Pushpa and her family, increasing the compensation. Royal Sundaram Alliance Insurance Co. Ltd., along with the driver and vehicle owner, was directed to deposit the revised amount with interest.
"The insurance company and the fifth and sixth respondents are directed to deposit the award amount now determined by this Court," stated the judgment.
The court ruled against the insurance company's appeal and increased the compensation for Senthil Kumar's family. This decision provided financial relief to the family and highlighted the importance of accountability in traffic accidents.
