Quick Summary: A businessman from Telangana, U Pavan Kumar Reddy, asked the court to drop the charges against him under the Bharatiya Nyaya Sanhita. The court, led by Judge Tirumala Devi Eada, decided not to dismiss the case but allowed the investigation to continue with certain guidelines.

Businessman's Request to Drop the Case

U Pavan Kumar Reddy, a business owner from Telangana, filed a request under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023. He wanted to stop the legal proceedings in Case No.170 of 2025, filed at the Gadwal Rural Police Station. The charges involved alleged violations under Sections 316 (5) and 318 (4) of the Bharatiya Nyaya Sanhita, 2023.

What Happened in Court

The court listened to arguments from Mr. Gujjula Madhusudan, who represented U Pavan Kumar Reddy, and Mr. Jithender Rao Veeramalla, the Additional Public Prosecutor. Although the initial request was to drop the case, U Pavan Kumar Reddy's lawyer asked that the police be instructed to continue the investigation by sending a notice under Section 35(3) of the BNSS.

"The Additional Public Prosecutor did not disagree with this."

Court's Decision to Continue the Investigation

Judge Tirumala Devi Eada looked over the details of the case and found that the claims did not fully meet the requirements for an offense under Section 318 (4) of the BNS. Since the alleged offenses come with a punishment of less than seven years, the court decided not to drop the case but instructed U Pavan Kumar Reddy to help with the investigation.

U Pavan Kumar Reddy was told to meet with the Investigating Officer by November 25, 2025, and the officer must follow certain procedures according to the BNSS guidelines and the Supreme Court's directions in Arnesh Kumar v. State of Bihar.

"The businessman must provide his side of the story and work with the Investigating Officer whenever needed."

Final Notes on the Request

The court closed the criminal request with these observations, making sure that all procedures are followed according to the law. Any other pending requests related to the case were also closed.
