Hey there! Today, we're diving into a pretty intense court case from Mumbai. It's all about some folks being told to leave their homes because they're on railway land without permission. Let's break it down!

The Case of Unauthorized Homes

On January 23, 2025, the Estate Officer and Divisional Engineer of the Western Railway in Mumbai told several residents to leave their homes. Why? Because these homes were built without permission on railway land in Malad (East), Mumbai.

Who's Involved?

The case involves 25 complaints, all challenging the same order. The residents, like Prabhat Harichand Gechand and others, have been living in these homes since 1980. They claim that they've been there long enough to deserve some rights or compensation.

The Notice

On August 29, 2022, the railway authorities sent out notices to the residents. This was under a law about removing people from public land. The residents replied, trying to prove they should be allowed to stay.

"Prabhat Harichand Gechand and others submitted their responses on 13th October 2023."

Appeals and Arguments

The residents took their case to the City Civil Court in Mumbai, but on May 6, 2025, their appeal was turned down. They argued that the government had rules that should protect them, referring to a decision from December 12, 2000.

Court's Decision

The court, led by Judges Ravindra V. Ghuge and Abhay J. Mantri, decided on February 26, 2026, that the eviction order was legal. They said the residents didn't prove they were eligible for any special treatment under government rules.

"Prabhat Harichand Gechand and others are not entitled to any help under the said Government Resolution."

What Happens Next?

The court gave the residents 60 days to leave. If they don't, the railway can remove them with police help. However, the court did suggest that if there's a plan to help relocate people, the residents might apply for it.
