Quick Summary: The court dismissed an appeal by Packirisamy, who was found guilty under the POCSO Act. He had already finished his time in prison, making the appeal pointless.

The Case Background

Packirisamy, also known as Raja, was found guilty by the Sessions Judge in Karaikal for breaking Section 6 of the Protection of Children from Sexual Offences Act, 2012. The original decision, dated November 29, 2017, sentenced him to 10 years of hard labor in prison and a fine of Rs. 1,000. If he didn't pay the fine, he would have to spend an extra three months in prison.

The Appeal Process

Packirisamy tried to challenge the decision, but his first lawyer didn't seem very interested. On June 21, 2024, Mr. I. Syed Sibghatulla was appointed as his Legal Aid Counsel to keep the appeal going.

"The person accused in Spl.S.C.No.07 of 2016 was found guilty by the trial Court... sentenced him to serve 10 years of hard labor in prison."

Sentence Already Served

The Legal Aid Counsel noted that Packirisamy had already finished his time in prison. The Public Prosecutor asked for confirmation from the prison officials. On September 15, 2025, the Deputy Superintendent of Jail, Karaikal, confirmed that Packirisamy was released on May 23, 2025, after completing his sentence with some time reduced.

Court's Decision

Since the sentence was already served, Justice M. Nirmal Kumar dismissed the appeal as unnecessary. The judgment noted that there was nothing left to decide.

"From the report, it is seen that the person had already completed his time in prison... Therefore, there is nothing left to discuss in the appeal."

Verdict Summary

The appeal was dismissed because Packirisamy had already completed his sentence, making further legal action unnecessary.
