Summary: The Bombay High Court has canceled the police report against GTL Infrastructure Limited filed by the Central Bureau of Investigation (CBI). The court found no proof of cheating or corruption, clearing GTL Infrastructure Limited of accusations related to financial wrongdoing.
On August 16, 2023, the Central Bureau of Investigation (CBI) filed a police report against GTL Infrastructure Limited (GTLIL) and unknown government workers. The charges were serious: planning illegal activities under the Indian Penal Code and bad behavior under the Prevention of Corruption Act.
"GTL Infrastructure Limited wanted the police report filed by the CBI, which accused them of financial wrongdoing, to be canceled."
The problem started back in 2011 when GTL Infrastructure Limited faced money issues. They couldn't pay back loans from a group of 19 banks. This led to an attempt to restructure their debt, which didn't work out, causing the banks to turn a part of the debt into company shares.
"The debt of Rs.7,200 crores was turned into company shares, but GTL Infrastructure Limited was accused of using the money for other purposes."
The CBI accused GTL Infrastructure Limited of using loan money through suppliers without paying back or getting goods. This money was allegedly put into other companies. The CBI claimed this caused big losses for the banks.
"The CBI said the banks lost money because 79.3% of the money owed was given away."
GTL Infrastructure Limited defended itself, saying it was a real business providing telecom infrastructure. They argued that their money problems were due to outside reasons like the 2G Spectrum case and not because of any cheating.
"GTL Infrastructure Limited argued that its money problems were due to outside market conditions, not cheating."
The court, led by Chief Justice Shree Chandrashekhar and Justice Gautam A. Ankhad, found no proof of cheating. The Forensic Audit Report and other papers showed no unusual transactions. The court noted that no government workers were identified as involved in any plan.
"The Forensic Audit Report did not find any cheating or misuse of funds."
On February 27, 2026, the court canceled the police report, saying that the investigation did not find any accused or proof of criminal behavior. The judges emphasized that the investigation seemed to be an aimless search without solid reasons.
"The court found no reason for the police report and canceled it, allowing GTL Infrastructure Limited to continue its operations without the cloud of accusations."
The court decided that there was no evidence of cheating or wrongdoing by GTL Infrastructure Limited, and therefore, the police report was canceled. This allows the company to continue its business without the accusations hanging over them.
This case serves as a reminder of the complexities involved in financial investigations and the necessity for clear, substantial evidence before legal actions are taken.
