The Case for Release

Murugan, Mahendran's father, filed a request to the court under a specific article of the Constitution. The request aimed to cancel the detention order and free Mahendran. The case was heard by Judges G.K. Ilanthiraiyan and R. Poornima.

Delay in Approval

The detention order was sent to the government on May 8, 2025, four days after it was issued. According to the law, the order should be sent right away for approval. This delay was a major point in the request to the court.

"No such order shall remain in force for more than twelve days after the making thereof, unless, in the meantime, it has been approved by the State Government."

Court's Decision

The court found the delay in sending the detention order for approval unacceptable. As a result, the detention order was canceled on December 17, 2025. Mahendran was ordered to be released unless he was needed for another case.
