
The court has ordered the registration of a property sale document in Ranga Reddy District after resolving a disagreement about its processing. Judge K. Sarath handled the case, ensuring that Mr. Boyapally Shekar Reddy could move forward with the registration.
Mr. Boyapally Shekar Reddy, a businessman from Ranga Reddy District, filed a formal request. He was upset because the local official in Maheshwaram Mandal wasn't processing his sale document. This document involved two pieces of land in Mankhal Village, and he needed them registered to complete his property deal.
Judge K. Sarath listened to both sides. The government lawyer, Ms. S. Sravanthi, explained that Mr. Boyapally Shekar Reddy hadn't even submitted the document for registration. She assured that if he did, the authorities would follow the rules under Section 71 of the Registration Act, 1908.
Section 71 is important here. It says:
"Every Sub-Registrar refusing to register a document...shall make an order of refusal and record his reasons..."
This means if a document is not accepted, the reasons must be written down, and Mr. Boyapally Shekar Reddy must be informed.
Judge K. Sarath decided that the Registering Authority should accept and process the document if it follows the Registration Act, 1908, and the Indian Stamp Act, 1899. However, if there are any issues, they must be clearly explained to Mr. Boyapally Shekar Reddy.
The court's decision didn't determine whether Mr. Boyapally Shekar Reddy was rightfully entitled to the registration. It only made sure that the process was fair and followed the law. This decision helps make the registration process clearer, ensuring transparency and accountability.
