Summary: A long-standing argument over land and religious leadership in Udgir has reached a turning point. The High Court has canceled a previous decision and asked the Atiyat Court to look at the claims of who should inherit the land again.
This case involves several people, all claiming rights over the land and leadership of the Hazarat Sayed Chand Dargah and Mosque in Udgir. On one side, we have Syed Hidayatali, who was previously announced as the next leader. Opposing him are various challengers, including Syed Abdul Razzak Syed Multani and others, who argue against his claim.
The drama began when the Additional Collector (Atiyat), Latur, declared Syed Hidayatali as the rightful next leader to the Atiyat grant. This decision gave him control over the Dargah and the associated lands. The challengers were not happy with this and took the matter to court, arguing that the decision was wrong.
"The Additional Collector made a mistake by saying that Syed Hidayatali was chosen as the leader by Syed Abdul Kasim using a power of attorney without deciding if the deceased was the leader himself."
Atiyat grants are old land grants, and figuring out who inherits them is often complicated. In this case, the challengers argue that such grants are passed down through family and cannot be given away through a power of attorney, as was done by Syed Abdul Kasim to Syed Hidayatali.
Judge R. M. Joshi of the High Court found that the previous decision was made without looking at all the facts. The court ordered a new investigation into the matter, emphasizing that the Atiyat grant should be passed down through family.
"The order of Additional Collector, Latur passed in proceedings bearing File No. 2013/Religious/CR-96 dated 07.03.2014 stands canceled."
The Atiyat Court will now have to conduct a new investigation, giving all parties a fair chance to present their case. Until then, the land will remain with the government, and it can be rented out temporarily.
This case highlights the complexities involved in land arguments, especially those mixed with religious and historical grants. The final decision will not only affect the people involved but also set an example for similar cases in the region.
