
In a recent decision, the court ruled that Gold Cause Construction must give Anand Prakash Gupta two separate shops, not just one large space. This decision came after a long legal battle over agreements made back in 2005.
Back in 2005, Gold Cause Construction and Anand Prakash Gupta made agreements for two commercial spaces in Paradise Mall, New Delhi. These spaces were supposed to be separate shops, F-39 and F-40.
Gold Cause Construction later said that the original plan changed, and the two shops didn't exist anymore. They offered new spaces, F-02 and F-03, which were bigger but combined into one large space.
The court appointed a Local Inspector to check the site. It turned out that the new spaces were indeed different from what was initially agreed. This led to a disagreement over whether Anand Prakash Gupta should get one large space or two separate ones.
Judge Saurabh Banerjee decided that Gold Cause Construction must provide Anand Prakash Gupta with two separate shops, as originally agreed. The company had to complete the paperwork and hand over the new shops, F-02 and F-03, while accepting the price changes.
"The company themselves identified two new shops which were empty and available in place of the two original shops."
The court found no issues with the earlier decision and rejected the appeals by Gold Cause Construction. Judge Banerjee emphasized the importance of sticking to the original agreements and ensuring fairness.
