Quick Summary: The court has given M/s Sandhya Hotels Private Limited another chance to present evidence in a long-standing case. Justice P. Sam Koshy decided to cancel the earlier decision that stopped them from showing their evidence.
In a legal battle that has been going on for over ten years, M/s Sandhya Hotels Private Limited and its director, Mr. S Sreedhar Rao, were in a difficult situation. They were the ones being sued in a case filed by Smt Amrita Mishra. The original case, numbered O.S.No.947 of 2015, was being heard in the City Civil Court, Hyderabad.
At first, the XI Additional Chief Judge decided to stop M/s Sandhya Hotels Private Limited and Mr. S Sreedhar Rao from showing their evidence. This decision was made on April 21, 2025. They argued that they couldn't present their evidence because they had filed a request accusing Smt Amrita Mishra of lying under oath, which was still being considered.
"It would not have been right for M/s Sandhya Hotels Private Limited and Mr. S Sreedhar Rao to appear before the Trial Court to show evidence," their lawyer argued.
On the other hand, Smt Amrita Mishra's lawyer claimed that M/s Sandhya Hotels Private Limited and Mr. S Sreedhar Rao were given plenty of chances to show their evidence but were avoiding it. The case had already dragged on for more than ten years.
When the matter came up for hearing again, Justice P. Sam Koshy decided to give M/s Sandhya Hotels Private Limited and Mr. S Sreedhar Rao another chance. He canceled the previous decision and told them to come with their witnesses on August 29, 2025.
"The decision made by the Trial Court to stop the evidence of M/s Sandhya Hotels Private Limited and Mr. S Sreedhar Rao is canceled," said Justice Koshy.
M/s Sandhya Hotels Private Limited and Mr. S Sreedhar Rao must now appear on the specified date with their evidence. If they fail to do so, the court's current order will not be valid anymore. Smt Amrita Mishra will also be ready to question the witnesses.
The Civil Revision Petition was allowed, and all pending extra requests were closed. However, no costs were ordered.
