Here's a breakdown of a recent court decision involving a land dispute in Siddipet. The case revolves around a family's fight over property rights, and the court's final decision to dismiss the petition.
Thipparaboina Yellaiah, the person who brought the case to court, claimed that his father owned a piece of land in Akbarpet, Bhumpally Village, Siddipet District. After his father's death, Yellaiah's mother inherited the land. However, other family members, Thipparaboina Bal Narsaiah, Thipparaboina Bal Rajaiah, Thipparaboina Mallaiah, and Thipparaboina Venkataiah, began claiming ownership and trying to take over the property.
Yellaiah's mother took legal action by filing a case (O.S.No.67 of 2021) against the relatives who were disputing the ownership, including Thipparaboina Nathi Balaiah. She wanted the court to officially recognize her ownership, stop the relatives from interfering, and update the official records to show she owns the land. However, this case and a related request are still being decided in court.
"Respondent Nos.4 to 7 started claiming the said property and trying to interfere with the possession of the petitioner’s mother."
While the lawsuit was ongoing, Yellaiah filed a request to the court to stop Thipparaboina Bal Narsaiah, Thipparaboina Bal Rajaiah, Thipparaboina Mallaiah, and Thipparaboina Venkataiah from changing the official records and getting ownership documents in their names. He argued that what they were doing was not right while the main case was still unresolved.
Judge K. Lakshman decided that Yellaiah's request was too early. Since the main lawsuit and related request were still being decided, Yellaiah's mother should focus on those first. The court pointed out that Yellaiah was trying to get a decision through this request that his mother had not yet received in her ongoing case.
"Petitioner is not entitled for any relief much less the relief sought in the present Writ Petition."
The court dismissed the request but allowed Yellaiah's mother to continue her legal fight in the original case. She can ask for temporary decisions, a final decision, and then approach the relevant authorities to make it happen.
The court dismissed Yellaiah's request because it was too early, as the main case was still ongoing. However, Yellaiah's mother can continue her efforts in the original lawsuit to resolve the property dispute.
No costs were ordered, and all pending applications were closed.
