Telangana High Court: Prisoner's Case Dismissed After Early Release

Kistigari Dilip Kumar, a prisoner from Cherlapalli, asked the court to let him out early. However, the case was dropped because he had already been released for a special occasion.

What the Petitioner Wanted

Kistigari Dilip Kumar filed a request using a part of the Indian Constitution. He wanted the court to say that the actions of the State of Telangana and the person in charge of the Central Prison Cherlapally were wrong for not considering his early release. He claimed this went against a specific government order from 2016.

"The action of the State of Telangana and The Jailer in not considering the petitioner for premature release... is wrong, unfair, goes against the Constitution, random, forceful, and cannot be supported..."

Arguments in Court

K.B. Ramanna Dora, the lawyer for Dilip Kumar, said that his client's request for early release was ignored, and he asked the court to order his release. On the other hand, Mr. R. Laxmikanth Reddy, representing the State, explained that Dilip Kumar was already let out on Gandhi Jayanthi, 03.10.2020, under a different government order.

Court's Decision

Justice N. Tukaramji, who listened to the case, pointed out that since Dilip Kumar was already released, the issue was no longer important. The case was dismissed as unnecessary, meaning there was no need to continue.

"Considering the information and since the petitioner is released, the issue raised in this case does not need a decision..."

Summary

The court dismissed the case without making anyone pay for legal costs, and all other related requests were closed. Dilip Kumar had already been released early, making his request unnecessary.
