
In a recent decision, Judge C.V. Bhaskar Reddy turned down two challenges related to a car accident case in Nizamabad. The case involved a person named Rajesh Kumar, who was asking for more money after being hurt, and an insurance company, Bharat Insurance Ltd., who disagreed with his request.
On June 5, 2015, Rajesh Kumar got hurt in an accident with a tractor and trailer in Saloora Village. He asked for ₹3,00,000 as compensation, saying he had serious injuries like broken bones and cuts. He was treated at two hospitals.
Bharat Insurance Ltd. argued against the request, mentioning a 19-day delay in reporting the accident to the police. They suggested the accident was made up to get money and said the amount he asked for was too high.
"The accident was falsely implicated to claim compensation," argued Bharat Insurance Ltd.
The Tribunal decided that the accident was due to careless driving. They awarded ₹1,60,300 with 7.5% interest, making the vehicle owner and Bharat Insurance Ltd. responsible. The delay in reporting to the police was explained and not considered a problem.
Rajesh Kumar wanted more money, saying his injuries weren’t fully considered. Bharat Insurance Ltd. argued the opposite, saying the delay in reporting and medical issues were ignored. Judge Reddy found the Tribunal's decision well thought out and dismissed both challenges.
"The Tribunal has passed a well-reasoned judgment," stated Judge Reddy.
Both challenges were turned down, keeping the original decision about compensation the same. Judge Reddy’s decision highlighted the good reasoning of the Tribunal and found no need for any changes.
