The Pariwar Co-operative Housing Society argued that the case was too old and should be dismissed because too much time had passed since the issue first came up. However, the court found no evidence that the society had refused to fulfill the contract within the time limits specified by law.

The deal started in 2001 when the society agreed to let Patel develop the land. By 2003, a formal agreement was in place. Patel fulfilled his part by paying the agreed amount and constructing the flats. However, the society delayed handing over the land due to other pending lawsuits.
