Justice Tirumala Devi Eada recently handled a request to cancel legal actions against seven people accused under the Dowry Prohibition Act and Bharatiya Nagarik Suraksha Sanhita (BNSS). Here's what happened.

The Case Background

The people involved, including Jala Surya Chandra, Smt Jala Nagamani, Jala Venkateswarlu, Smt Avula Vennela, Smt Yallavula Kranthi, Avula Samba Siva Rao, and Yallavula Sai Ram, were facing charges under Section 85 of the BNSS and Sections 3 & 4 of the Dowry Prohibition Act. These charges were filed at the Nalgonda II Town Police Station.

Legal Arguments

The lawyer for the accused, Sri C. Hari Preeth, argued for a specific way of handling the case, focusing on Section 35(3) of the BNSS. This section talks about the steps police must take for crimes with punishments less than seven years.

Police Response

The Additional Public Prosecutor, Sri Jitender Rao Veeramalla, mentioned that a notice had already been given to one of the accused, Avula Samba Siva Rao, and asked for similar notices for the others.

"The punishment for the crimes alleged against the accused is less than seven years." — Additional Public Prosecutor

Court's Decision

Justice Tirumala Devi Eada told all the accused to meet with the Investigating Officer by November 7, 2025. The court stressed the importance of following the law and guidelines from a previous case, Arnesh Kumar v. State of Bihar.

"The Investigating Officer shall complete the investigation strictly in accordance with law." — Justice Tirumala Devi Eada

Summary of Verdict

The court decided to close the petition, making sure that the investigation carries on legally and fairly. This case shows how important it is to follow the rules in criminal investigations.
