
Here's the scoop: S. Parvathi wanted her land back, but the High Court in Madras said no. She had been hoping to get her land returned, but the court decided against it on December 4, 2025.
S. Parvathi, from Thiruvallur District, filed a request. She wanted the government to reconsider giving her land back. Her land was taken under a law from 1894 to build homes for Ennore Port Trust employees. But she says the land wasn't used for that purpose, and she's still living there.
Parvathi's lawyer argued that since the land wasn't used, it should be returned to her. They filed a request on September 22, 2023, asking for this under a section of the 1894 law.
"The lands were not used for the said purpose and that the petitioner is still in occupation thereof."
The government, represented by Mr. Abishek Murthy, said that the 1894 law doesn't allow for Parvathi's request. They referred to a Supreme Court decision, saying the new rules from 2013 don't apply to old cases like this one.
Judge Senthilkumar Ramamoorthy looked at the facts. The land was taken in 1999 and 2003, and payment was given back then. Since Parvathi waited over two decades to ask for the land back, the court didn't think her request was fair.
"The request of the petitioner cannot be accepted especially in view of the inapplicability of Section 101 of Act 30 of 2013."
The court dismissed Parvathi's request without any cost orders. So, for now, she won't be getting her land back.
