Summary: On February 18, 2026, the Delhi High Court, led by Judge Harish Vaidyanathan Shankar, chose one person to settle a disagreement between Shri Krishna Super Speciality Institute of Ayurveda and the Director General of Health Services, Govt of NCT of Delhi.

Background of the Case

Shri Krishna Super Speciality Institute of Ayurveda asked the court to appoint one person to settle arguments that came up from an agreement with the Director General of Health Services, confirmed by a letter dated March 16, 2022.

The Arbitration Clause

The agreement included a part that said:

“If any question, disagreement, or argument comes up at any time under the conditions of the Agreement... it should be decided by one person chosen by the Lt. Governor, N.C.T. of Delhi...”

Legal Framework and Judicial Role

The court explained that its job was just to check if there was an agreement to settle arguments this way. Judge Shankar mentioned a past decision by the Supreme Court, saying:

“The examination under Section 11(6-A) is only to see if an agreement to settle arguments exists...”

Agreement on Arbitration

Mr. Abhinav Sharma, speaking for the Director General of Health Services, agreed to choose one person to settle the argument. Both sides agreed that since the disagreement involved about Rs. 15,00,000, it should be handled by the Delhi International Arbitration Centre (DIAC).

Appointment of the Sole Arbitrator

Judge Harish Vaidyanathan Shankar chose Ms. Nisha Bhambhani as the one person to settle the argument. The process will happen under DIAC, with both sides paying the costs equally.

Summary of the Verdict

The court made sure that the process respects the original agreement between the parties, with little interference from the court. The petition was settled in these terms, without giving any opinion on who is right or wrong in the case.
