In a nutshell: On December 16, 2025, the Madras High Court decided that C. Dhanraj's request to cancel certain sale papers couldn't be granted. The court suggested that Dhanraj take the matter to a regular court instead.
C. Dhanraj claimed ownership of a piece of land in Survey No.647/4, measuring about 2.97 ½ cents. He said that two people, Arunachalam and A. Palanisamy, faked a sale paper on October 12, 2021. This paper was registered under Document No.6147/2021. Dhanraj argued that this fake document led to more transactions.
Dhanraj submitted a request on October 13, 2025, to the District Registrar in Erode District, asking to cancel several sale papers (Document Nos. 6147/2021, 1428/2022, 3751/2022, and 6426/2024). These papers were registered at the Sub Registrar Office in Sathiyamangalam.
Judge Senthilkumar Ramamoorthy, who was in charge of the case, said that the officers who register these papers don't have the power to cancel them according to the Registration Act, 1908.
"The registering authorities are not empowered to cancel sale deeds after registration."
Since the law doesn't allow it, the court couldn't issue an order to cancel the papers as Dhanraj asked.
The court advised Dhanraj to take his case to a regular court for further action. This means he will need to start a new legal process to try to cancel the disputed sale papers.
So, while the High Court didn't cancel the papers, it did guide Dhanraj on what he should do next.
