INTEGRO FINSERV PRIVATE LIMITED Vs MR. SANTOSHKUMAR RAMSAJEEVAN DEWIVEDI AND ANR
This story began in 2015 when Integro Finserv Private Limited asked the court to take action against Santoshkumar Ramsajeevan Dewivedi. Even though a warrant that doesn't allow bail was given, it hasn't been carried out because Dewivedi moved from Maharashtra to Varanasi, Uttar Pradesh.
On July 23, 2025, the court issued another warrant for Dewivedi. However, because of problems during the 2024 Vidhan Sabha Elections in Maharashtra, the warrant couldn't be carried out. The court told the registry to try again, but it still didn't work.
"The registry has contacted Mr. Vidyashankar Shukla, Inspector on Cell Phone seeking to carry out the warrant, however, no report has been received."
Efforts to carry out the warrant moved to Varanasi. The warrant was sent to the Senior Inspector at Manduadih Police Station. Despite several reminders in September, December 2025, and January 2026, no report of action was received.
On February 4, 2026, Mr. Anil Singh, the Additional Solicitor General, talked about parts of the Bharatiya Nagarik Suraksha Sanhita, 2023, which guide how warrants are carried out in different places. These include instructions on sending warrants to local authorities to be carried out.
"A warrant of arrest may be carried out at any place in India."
Judge Madhav J. Jamdar expressed concerns over the delay, noting that many requests to carry out actions, especially from financial institutions, remain unresolved. The court has asked Mr. Singh to suggest ways to make sure warrants are carried out on time.
The court has ordered a new warrant to be sent to the Commissioner of Police in Varanasi. The goal is to make sure such delays do not continue to stop justice.
This case shows the difficulties in carrying out warrants across state lines and the need for a better system to prevent such long delays in the future.
