The case involves a request for review filed by Vembuli and P. Thulasipillai against Arumugam. Arumugam had filed a case asking for a permanent order to stop Vembuli and Thulasipillai from interfering with his property, which he says he bought in 2002.
Vembuli and Thulasipillai argued that the case was a misuse of the legal system. They claimed it was filed to cancel the effect of a pause granted in a related case (O.S. No.35 of 2022) involving the same property.
"The present suit is a misuse of the legal system," argued Mr. R. Suriya Prakash, lawyer for the petitioners.
Arumugam's lawyer, Mr. S. Sriram, argued that the properties in question in the two cases were different, even though they were in the same area. He said each case had a different reason for being filed.
Judge R. Sakthivel noticed that the properties indeed had different survey divisions. The judge observed that the reasons for the two cases were different, with different sale documents and timelines.
"This court believes there is an issue worth examining in this case and therefore, a trial is necessary."
The court referred to a Supreme Court decision, emphasizing that special powers should be used carefully and not to skip regular procedures.
The court rejected the request by Vembuli and Thulasipillai, stating there was no good reason to cancel the case. The trial for the permanent order will continue in the District Munsif cum Judicial Magistrate Court, Cheyyur.
