On February 24, 2026, the Madras High Court made a decision on a request to review a case about a land dispute in Cheyyur. Judge R. Sakthivel was in charge of the case, which involved a request to dismiss a lawsuit about canceling a sale agreement.
The case is about a piece of land in Panaiyur Village, Cheyyur Taluk, in Changalpattu District. The people who brought the case, Manivannan and Arumugam, said that the land originally belonged to Meenakshi Ammal and Selvaraj. They said that Arumugam was given the right to sell the land, and he sold it to Manivannan on July 4, 2008.
Things got complicated when a cancellation document was signed on October 4, 2017. The plaintiffs claimed that this document was obtained by the defendant, P. Thulasipillai, by using unfair pressure, possibly involving the police. They wanted the court to declare this cancellation invalid.
"The Defendant tried to disturb the Plaintiffs' peaceful use and enjoyment of the land."
P. Thulasipillai, the defendant, argued that the land was his because of a family division in 1995. He claimed the plaintiffs' lawsuit was pointless and a misuse of the legal system, and he wanted it to be dismissed.
Judge R. Sakthivel decided not to dismiss the lawsuit. The judge emphasized that the case presented a "triable issue," meaning it needed to be heard in court. The court referred to past decisions, noting that the power to dismiss such cases should be used carefully.
"This Court believes that there is a real issue to be tried in this case and therefore, a trial is necessary."
The court rejected the request to dismiss the lawsuit, allowing the case to continue in the District Munsif cum Judicial Magistrate Court in Cheyyur. This means the plaintiffs will have their chance in court to prove their claims.
This decision shows the court's careful approach in dismissing cases without a full hearing, making sure that all parties have a chance to present their evidence.
