Judge Nagesh Bheemapaka: Reconsideration of Tender Ban for Food Corporation of India Petitioner

In a recent court decision, Judge Nagesh Bheemapaka looked into a request about a ban on tendering. The person who made the request, Rajesh Kumar, wanted his two-year ban to be shortened to one year. The court told the authorities to think about his request again.

Rajesh Kumar's Request

Rajesh Kumar was not allowed to participate in Food Corporation of India bids for two years. He filed a petition asking the court to shorten this to one year. He argued that the ban was unfair and went against basic fairness.

"The action... as illegal, arbitrary and violative of the principles of natural justice."

Hearing Both Sides

The court listened to both parties. Rajesh Kumar's lawyer, Sri A. Prabhakar Rao, urged for a quick reconsideration of the ban. On the other side, Sri D. Srinivas, representing the other party, agreed that Rajesh Kumar's request should be reviewed if it was still pending.

Court's Decision

Judge Nagesh Bheemapaka decided that Rajesh Kumar's request should be looked at again. The court ordered the other party to make a decision within four weeks and let Rajesh Kumar know.

"This Writ Petition is disposed of directing respondent No.2 to consider the petitioners’ representation... within a period of four (04) weeks."

Rajesh Kumar might soon get another chance to participate in bids. The decision highlights how important fairness is in decisions made by authorities and the role of the court in making sure justice is served.
