
In an interesting turn of events, the High Court has ordered a fix for a tax mistake involving M/s Qualitus Pharma Solutions. The company was wrongly issued tax notices for a period where they owed nothing. Let's break down what happened.
M/s Qualitus Pharma Solutions found themselves in a tricky situation. Even though earlier decisions showed they didn't owe taxes for 2017-18, they received notices saying they did. These notices asked for tax, interest, and fines for the period from July 2017 to March 2018.
"The proceedings were dropped," but the company still had to go to court because of the wrong notices.
The case was heard by Chief Justice Sri Aparesh Kumar Singh and Justice G.M. Mohiuddin. During the hearing, the company’s lawyer, Mr. B. Krishna Reddy, argued against the incorrect notices. On the other side, Mr. Dominic Fernandes represented the Central Board of Indirect Taxes and Customs.
The court told The Assistant Commissioner of Central Tax to fix the errors in the notices. These notices were issued under the Central Goods and Services Tax Act, 2017. The court gave them two weeks to make the corrections.
"We direct The Assistant Commissioner of Central Tax to rectify the two proceedings," the court ordered.
The case is now closed, and the court didn’t order any costs. This decision is a relief for M/s Qualitus Pharma Solutions, who can now move on without worrying about incorrect tax demands.
