Quick Summary: Vijay Kumar's attempt to challenge a court order in a loan dispute with Mamta Garg was dismissed by the Delhi High Court on December 3, 2025. The court allowed a detailed check of a disputed document, siding with Mamta Garg.
Vijay Kumar and Mamta Garg had a money-related disagreement. Mamta claimed Vijay borrowed Rs. 11,50,000 but didn't pay it back. She filed a case to get Rs. 15,50,000, including interest. Vijay, however, denied the loan, saying the evidence against him was fake.
Mamta presented a written statement, Ex.PW1/1, where Vijay supposedly admitted to borrowing Rs. 8,00,000 with 2.5% monthly interest. Vijay argued this document was not mentioned in the initial complaint and called it an "unrelated document."
"Just because a document has been given an exhibit number, it does not mean that the document is proven," argued Vijay's lawyer.
Judge Girish Kathpalia ruled that the document could be checked by a private expert hired by Mamta. The court found no problem with the lower court's decision to allow this detailed check.
"The statements need to include only a short version of the important facts," stated Judge Kathpalia.
Vijay had objected to the document during earlier proceedings, but his objections were dismissed in January 2019. He didn't challenge that decision further, weakening his current position.
Judge Kathpalia dismissed Vijay's request as unnecessary, imposing a Rs. 10,000 penalty, to be paid within a week. The decision was sent to the lower court for their records.
