In a recent decision on November 28, 2025, the Delhi High Court canceled an order by the Lokpal of India against officials from the National Productivity Council (NPC). The officials were accused of breaking rules in hiring and promotions.

Background of the Case

The problem started with a complaint on July 4, 2024, claiming there were serious rule-breaking actions in NPC's hiring and promotions. The Lokpal asked the CBI to do an initial investigation. The investigation found rule-breaking actions, leading to warnings against the officials.

Allegations of Irregularities

  • Hiring Violations: Alleged breaking of rules in hiring and promotions, going against NPC Service Rules.
  • Promotion Concerns: Promotions on March 28, 2023, allegedly skipped required steps and unfairly favored less experienced employees.
  • High Power Committee (HPC) Findings: The HPC suggested canceling certain promotions, but the Secretary of DPIIT sent it to NPC's Governing Body instead.

Court Proceedings

The people who brought the case, led by Rajesh Kumar Singh, argued against the Lokpal's January 6, 2025 order, saying it was unfair because they were not given a chance to speak before the Lokpal formed an initial opinion.

Court's Analysis

  • Violation of Fairness: The court found that the Lokpal sent warnings after forming an initial opinion, which should have only happened after hearing from the officials.
  • Procedural Mistakes: The Lokpal's order was considered too early and did not follow the rules set in Section 20(3) of the Lokpal Act.

Orders

The court, led by Justices Anil Kshetrapal and Harish Vaidyanathan Shankar, canceled the Lokpal's order and warnings, stressing the need for a fair chance to be heard before forming any opinion. However, the Lokpal can start the process again, following the correct steps.

This decision highlights the importance of fairness and following rules in investigations involving public officials.
