Sheikh Javid Sheikh Rashid, along with three others, was stuck in a cycle of temporary contracts despite working continuously since 2017. They were hired as firemen and drivers for the Malegaon Municipal Corporation. Their jobs were renewed every six months, but they never gained permanent status.
Judge Milind N. Jadhav heard the case. He found that Sheikh Javid Sheikh Rashid and his colleagues were unfairly kept on temporary contracts, despite working alongside permanent employees and performing important duties. The court noted:
"They have given the best years of their life in the service of the Corporation."
Petitioners' Stand: Their lawyer, Ms. Pavitra Manesh, argued that the employees had been working for years and deserved permanent jobs. They were doing regular tasks but were denied benefits due to technical details.
Corporation's Defense: The Malegaon Municipal Corporation, represented by Mr. S.S. Patwardhan, claimed money problems and government rules stopped them from offering permanent positions.
The court found the corporation's arguments not good enough. It stressed that the employees' continuous work justified their need for permanent jobs. The court ordered:
