Telangana High Court: Petitioners' Construction Case Dismissed as Infructuous

What's the Deal?

Two guys, Mohd Nazeeruddin and Md Zameer, were having trouble with their construction plans in Tandur, Rangareddy district. They wanted to build on their plots but faced some issues from the local authorities. They took the matter to court, but in the end, it didn't go as planned.

The Petitioners and Their Plans

Mohd Nazeeruddin and Md Zameer had plans to build on two plots in Tandur. They got the green light from the Municipal Council of Tandur, which is basically the local government, on March 13, 2015. Everything seemed fine, but then things got messy.

Trouble with the Authorities

The Municipal Council and the Tahsildar (a local revenue officer) were causing problems. They were stopping the construction, and Mohd Nazeeruddin and Md Zameer weren't happy about it. They claimed this obstruction was illegal since they had all the necessary permissions.

"Declaring the action of the Municipal Council and the Tahsildar in causing obstruction... as illegal."

Court's Decision

The case was heard by Justice Laxmi Narayana Alishetty. When the court session started, Mohd Nazeeruddin and Md Zameer's lawyer said the case was no longer relevant. It seems like whatever issues they had were resolved, or they decided not to pursue it further.

Case Dismissed

Because Mohd Nazeeruddin and Md Zameer no longer wanted to continue, the court dismissed the case as "infructuous," which is a fancy way of saying it was pointless to carry on. No costs were ordered, meaning neither side had to pay the other's legal fees.

"Recording the aforesaid submission... writ petition is dismissed as infructuous."

What Now?

With the case dismissed, the construction plans are no longer under legal scrutiny. Whether the building goes ahead or not is up to Mohd Nazeeruddin, Md Zameer, and the local authorities to sort out.
