Summary: Dayyala Madhu's request to cancel the legal case against him was denied. Instead, the court ordered a proper investigation into the alleged offenses of damaging public property.
Dayyala Madhu, a worker from Ellanthakunta Village, filed a request to cancel the legal case against him. The case, registered as Crime No.225 of 2025, involves accusations under Section 303 of the Bharatiya Nyaya Sanhita (BNS) and Section 3 of the Prevention of Damage to Public Property Act (PDPPA).
Justice Tirumala Devi Eada was in charge of the case. During the hearing, Madhu's lawyer, Mr. T. Sai Chand, initially wanted to cancel the case. However, he later asked for instructions for the police to continue the investigation with proper notice.
The Additional Public Prosecutor, Mr. Jithender Rao Veeramalla, did not object to this request.
Justice Eada decided not to go into the details of the case. Instead, she instructed Madhu to meet with the Investigating Officer by November 25, 2025. The officer must follow procedures outlined in Section 35(3) of the BNSS and follow Supreme Court rules from the Arnesh Kumar case.
"The petitioner shall submit his defense and co-operate with the Investigating Officer as and when required," stated Justice Eada.
The court's decision ensures that the investigation proceeds correctly, allowing Madhu to present his defense. The case highlights the process the court follows in dealing with accusations of public property damage, emphasizing following legal rules.
