Summary: Umesh Kumar, also known as Kanhaiya, was denied bail in a case involving a fake almond trade that happened in Delhi. The court, led by Judge Swarana Kanta Sharma, found the accusations serious and noted that the investigation is still in progress.
On April 26, 2024, Anuj Bansal filed a complaint in Delhi. He got a call from someone pretending to be Subhash Gupta, a well-known trader. The caller ordered 240 bags of almonds worth ₹35,53,680 and promised to pay later. When a second order was placed, Bansal became suspicious and contacted the real Subhash Gupta, who denied making such calls.
"The complainant had received a call from an unknown number... the caller had disclosed his name as Mr. Deepak Gupta."
The police found out that there was a group of people involved in the scam. The truck driver, Tajjammul, took the almonds to Aligarh, where they were moved to other vehicles. Phone records and mobile data connected the scam to several people, including Prempal and Tarun Sharma, who were allegedly involved in getting SIM cards using fake identities.
On June 16, 2024, Umesh Kumar and another accused, Kunal, were arrested. They used tricks to pretend to be Subhash Gupta and manage the scam. The investigation showed they used SIM cards obtained through a series of middlemen.
"The accused persons had made telephone calls to the complainant by using call spoofing techniques..."
Judge Swarana Kanta Sharma denied bail, pointing out the serious nature of the crime and Umesh Kumar's involvement in similar past cases. The court stressed that the investigation is ongoing, and important witnesses still need to be questioned.
"The trial is at an initial stage and material witnesses are yet to be examined."
The court decided not to release Umesh Kumar on bail due to the serious charges against him and his history of similar crimes. He will stay in custody as the investigation continues to uncover more details about the scam.
