Summary: Shyamsundar Agrawal, accused of cheating people in a land deal in Thane, Maharashtra, has been granted anticipatory bail by the Bombay High Court. The case involves claims of fake documents and misuse of a legal power to sell property that belonged to his family.

Accusations of Land Fraud

Shyamsundar Radhyesham Agrawal, a 60-year-old businessman from Bhayander, Thane, was accused of being involved in a land fraud case. The complaint was filed by Balwant Kashinath Patil, who claimed that Agrawal and others made fake documents to illegally sell family land.

The Alleged Scheme

The complainant, Balwant Patil, alleged that his family's ancestral land in Navghar, Thane, was fraudulently sold. The land was originally protected under laws meant to safeguard tenants. It was claimed that Agrawal wrongly claimed to have the legal power to act for the family and sold the land to his nephews for Rs. 80 lakhs, without the family's knowledge.

"The applicant falsely represented himself as Power of Attorney holder and sold the property to his nephews."

Legal Proceedings and Delays

The police report was filed in 2025, but the deals in question happened between 2003 and 2011. Agrawal asked for bail before being arrested after a lower court turned down his request on September 29, 2025. His defense argued that the police report was an attempt to disturb deals that were settled long ago.

Court's Consideration

Justice Amit Borkar of the Bombay High Court looked at several things, including the delay in filing the police report and the fact that there were official documents. The court noted that the deals had been public for years and were part of civil court cases.

"The delay in lodging the FIR is substantial. A period of twelve to fifteen years has elapsed from the time of the impugned transactions."

Bail Conditions

The court granted bail with rules to make sure Agrawal helps with the investigation. He must check in weekly with the police, cannot leave the area without permission, and must not mess with evidence or influence witnesses.

Verdict Summary

The court decided to balance Agrawal's personal freedom with the need for a thorough investigation. He was granted bail but with strict conditions to ensure the investigation is not affected. The investigation continues, focusing on the claims of fake documents and illegal land sale.
